Abstrak

Restorative justice in Indonesia has been regulated in laws and regulations which include: Regulation of the State Police of the Republic of Indonesia Number 8 of 2021 concerning the Handling of Crimes Based on Restorative Justice, Prosecutors' Regulation of the Republic of Indonesia Number 15 of 2020 concerning Dismissal of Prosecution Based on Restorative Justice, Decree of the Director General of the General Judiciary Agency Number, 1691/ DJU/ SK/ PS.00/ 12 20 Regarding Guidelines for the Implementation of Restorative Justice in the General Courts and Law of the Republic of Indonesia Number 11 of 2012 concerning the Juvenile Criminal Justice System. In the contents of the formulation related to restorative justice, there is a harmony of meaning that is generated, namely justice that is oriented towards restoration. Restoration-oriented justice has been aligned with the progressive legal correlation which assumes that the law is for humans, so that it can bring up the value of expediency above the value of justice and legal certainty. The method used is a normative juridical research which is qualitative analysis.
